Welcome to ExtraBite. These Terms of Service (“Terms”) are an agreement between you and ExtraBite. By creating an account or using the service, you agree to these Terms. Please read them carefully.
1. What ExtraBite is
ExtraBite is a marketplace where home bakers and cooks (“Sellers”) list homemade treats and baked goods for sale to people in their area (“Buyers”). ExtraBite itself is the platform — we connect Buyers and Sellers, process payments, and provide tools for communication and fulfillment. We are not the maker or seller of any food listed on the platform.
At launch, ExtraBite is limited to items that qualify under “Cottage Food Law” (CFL) rules: shelf-stable baked goods, candies, jams, honey, breads, and similar non-perishable foods. These Terms are effective as of the date above.
2. Account eligibility
To use ExtraBite you must:
- Be at least 18 years old.
- Provide truthful information about yourself, including your name, location, and (for Sellers) what you are making.
- Keep one account per person. Running multiple accounts to get around a suspension or to manipulate reviews is not allowed.
3. Seller responsibilities and CFL compliance
If you list items as a Seller, you are running your own small food business. ExtraBite gives you tools, but you are in charge of following the law.
You are responsible for your state's Cottage Food Law
Cottage Food Laws vary by state. Some states require a permit, some require a food-handler course, and most have a revenue cap or a list of allowed foods. You are solely responsible for knowing and following the CFL rules where you live. ExtraBite does not verify permits, kitchen inspections, or licensing, and does not monitor your total sales against your state's revenue cap.
CFL-eligible items only
By listing an item, you confirm that it is CFL-eligible in your state. In plain terms that means it is shelf-stable and does not require refrigeration to stay safe — for example, cookies, breads, cakes without dairy-based frostings that need refrigeration, candies, jams, and honey. You will not list perishable meals, items that need to be kept cold, or any food that is not allowed under your state's CFL.
Allergen labeling
You are responsible for accurately listing ingredients and allergens (for example, nuts, dairy, eggs, wheat, soy) on each listing. A missing or wrong allergen label can seriously harm a buyer. Take this seriously.
4. Payments must go through ExtraBite
All payments for goods sold on ExtraBite must be processed through ExtraBite's integrated checkout. Soliciting or accepting payment outside of ExtraBite (including but not limited to Venmo, PayPal, Zelle, Cash App, Apple Pay, Google Pay, cryptocurrency, or bank transfer) is prohibited and may result in account suspension.
This rule protects buyers (who get a record of the sale and recourse if something goes wrong), sellers (who get reliable payouts), and the platform (which uses checkout fees to keep running). This applies to messages, listing descriptions, Promote content, and profile bios.
5. Platform fees and payouts
- ExtraBite charges a 10% platform fee on each order, added to the buyer's subtotal at checkout.
- Seller payouts are batched weekly. There is a 7 to 14 day delay between an order being fulfilled and the money landing in your bank account. This window exists so that disputes, refunds, and chargebacks can be handled before funds leave the platform.
- Payouts are handled through Stripe Connect. By enabling payouts, you also agree to Stripe's Connected Account Agreement and Stripe Services Agreement.
6. Buyer responsibilities
If you use ExtraBite as a Buyer, you agree to:
- Communicate honestly with Sellers about allergies, pickup timing, and any changes to your order.
- Show up for scheduled pickups, or be available during the agreed delivery window. Repeated no-shows can lead to account suspension.
- Leave reviews that reflect your real experience. Do not trade, buy, or coordinate reviews. Do not leave reviews as retaliation for something unrelated to the order.
7. Cancellations and refunds
- Buyers may cancel an order for any reason while it is still in
pendingstatus. - Sellers may cancel before an order moves to
preparing, with a reason shared with the buyer. - Once an order is in
preparingor later, cancellation is at ExtraBite's discretion — usually we will try to mediate a partial refund or a re-delivery. - Refunds are returned to the original payment method. Depending on your bank, the refund can take 5 to 10 business days to appear.
8. Chargebacks and disputes
If you have a problem with an order, please contact us first — most issues can be resolved through our refund process without involving your bank.
- Filing a chargeback through your card issuer rather than using our refund process triggers a dispute fee of [DISPUTE FEE — $15–$25, TBD] to cover Stripe's dispute-handling cost and ExtraBite's administrative time. This fee is charged to the buyer's payment method on file.
- When a dispute is filed, ExtraBite will submit evidence on the seller's behalf — including the proof-of-delivery photo, GPS location, and order messages — to Stripe as part of the dispute response.
- A successful chargeback may still result in a seller's payout being clawed back by Stripe. Sellers accept this risk when they onboard.
9. Content ownership
You keep ownership of the photos, listing text, and Promote assets you upload to ExtraBite. By uploading content, you grant ExtraBite a worldwide, royalty-free license to display, reproduce, adapt, and promote that content on and off the platform — for example, featuring a top listing in our Instagram feed, marketing emails, or homepage.
You confirm that you have the right to upload the content you post, and that it does not infringe anyone else's copyright or trademarks.
10. Prohibited content and conduct
You may not use ExtraBite to:
- List food items that are not CFL-eligible in your state (for example, perishable meals, raw-milk products, or foods that require refrigeration for safety).
- List illegal items of any kind, including items that are prohibited by federal, state, or local law.
- Harass, threaten, or discriminate against other users based on race, religion, gender, sexual orientation, disability, or any other protected class.
- Solicit or accept payment off the platform (see Section 4).
- Scrape the service, abuse APIs, or try to bypass rate limits or moderation.
11. Account suspension
We can limit, suspend, or close accounts that violate these Terms. For serious violations — such as selling illegal items, fraud, or safety risks — we may act without prior notice. For less severe issues we will usually warn you first.
If you think an action on your account was a mistake, you can appeal by emailing support@tryextrabite.com. We will review and respond.
12. Dispute resolution
Most problems between a Buyer and a Seller can be solved by talking. Please use the in-order messaging thread first. If that does not work, ExtraBite can step in to mediate. In mediation, ExtraBite's decision is final.
Nothing in these Terms prevents you from taking a dispute to a small-claims court that has jurisdiction over you.
13. Disclaimers and liability
ExtraBite is provided “as is.” We do not guarantee the quality, safety, or accuracy of any Seller's food. We do not warrant that the service will be available without interruption or free of bugs.
To the fullest extent allowed by law, ExtraBite is not liable for:
- Food-borne illness, allergic reactions, or other harm caused by food listed by a Seller.
- Seller conduct off the platform, including missed pickups outside of the app or off-platform messaging.
- Indirect, incidental, or consequential damages.
Our total liability to you for any claim related to ExtraBite is capped at the total amount you have paid or received through the platform in the 12 months before the event that gave rise to the claim.
14. Changes to these Terms
We may update these Terms from time to time. If we make a material change — something that meaningfully affects your rights, fees, or the way we handle payouts — we will tell you by email at least 30 days before the change takes effect. Other changes (typos, clarifications, reorganization) take effect when we post the updated version here.
